1. Acceptance of Terms

By accessing or using the Octopus AI platform ("Service"), you agree to be bound by these Terms of Service. The Service is operated by Octopus AI ("Company", "we", "us"). If you do not agree to these terms, do not use the Service.

2. Description of Service

Octopus AI provides AI-powered competency assessment for seafarers, including structured interviews, certificate verification, STCW compliance checking, and talent pool management. The Service connects maritime candidates with shipping companies and crewing agencies.

3. User Accounts and Registration

Candidates register by providing personal information, maritime qualifications, and certificates. You are responsible for providing accurate and complete information. Providing false information may result in account termination and removal from the talent pool.

4. Automated Decision Support

The Service uses AI-powered automated decision support to evaluate candidate competencies. Assessment results (HIRE, HOLD, REJECT) are generated based on structured interview responses and calibrated scoring models. Candidates flagged as HOLD receive human review. Critical safety risk flags may result in automatic rejection for safety-critical positions. All decisions are explainable and recorded in audit-ready decision packets.

5. Certificate Verification

Uploaded certificates are verified against STCW requirements for the relevant rank and vessel type. Certificate verification includes checking expiry dates, mandatory requirements, and issuing authority authenticity. Octopus AI does not guarantee the accuracy of certificates provided by third parties.

6. Data Sources and Processing

We process data from the following sources: candidate-provided personal information, structured interview answers, uploaded certificates and documents, and admin verification records. All data processing is described in our Privacy Policy and conducted in accordance with GDPR and KVKK regulations.

7. Intellectual Property

All content, scoring algorithms, interview templates, and platform features are the intellectual property of Octopus AI. Candidates retain ownership of their personal data and uploaded documents.

8. Limitation of Liability

Octopus AI provides assessment tools and matching services. We do not guarantee employment outcomes. The Service is provided "as is" without warranties of any kind. Octopus AI is not liable for hiring decisions made by companies based on assessment results.

9. Termination

We may suspend or terminate access to the Service for violation of these terms, provision of false information, or any conduct that compromises platform integrity or safety.

10. Governing Law

These terms are governed by the laws of the Republic of Turkey. Disputes shall be resolved in the courts of Istanbul, Turkey.
